This Privacy Policy and our Terms of Use are binding legal agreements between you and us. If you do not agree to this Privacy Policy, do not use the Site and Services.

This Privacy Policy describes how and when we collect, use, or share information about you when you use the Site and Services. When using the Site and Services you consent to the collection, transfer, storage, or other uses of your information as described in this Privacy Policy. 

Regardless of which country you reside in or supply information from, or which product/service you choose, you authorize us to use your information in the United States in accordance with this Privacy Policy. If you are our client/customer, your information may be used by and shared with our third-party content-delivery network (“CDN”) partners in the course of providing support and other services in our ordinary course of business, meaning as is necessary to better serve you!

  Our business changes often, and this Privacy Policy and our Terms and Conditions may change also.

Flash LSOs and HTML5

   We may use Local Storage Objects (LSOs) such as HTML5 local storage and cookies to store form submitted information. Third parties with whom we partner to provide certain features on our website use LSOs such as HTML 5 to collect and store information. Various browsers may offer their own management tools for removing HTML5 LSOs.

   The security of your Personally Identifiable Information is of paramount importance to us. We follow generally accepted industry standards to protect the Personally Identifiable Information submitted to us, both during transmission and once we receive it. How We Use Information We Gather

   We use the information we gather to improve the experience of users of the Site and Services.

   You can always choose not to provide Personally Identifiable Information to us, although such refusal may prevent you from taking advantage of the features of the Site and Services.

   We will retain Personally Identifiable Information we process on behalf of our business partners for as long as needed to provide services to our Users. 

Lost or Stolen Information

   You must promptly notify us if your Personally Identifiable Information is lost, stolen, or used without permission. In such an event, we will work with you to remove your Personally Identifiable Information from your account and update our records accordingly.

Intercepted Information

   We cannot be held responsible for any information that has been eavesdropped, hacked, manipulated, or otherwise intercepted while in transit to us. When you send information to us, either directly or through a business partner, please be aware that you are fully responsible for any damage and or loss that is caused.

Business Transfers

If we should ever sell its assets, merge with another entity or file for bankruptcy, information collected from the Site and Services may be transferred as assets of Magnolia Rifle.

These websites are not under the control of Magnolia Rifle, and we are not responsible for the contents or activities of any linked sites or any link contained in a linked site. Applicable Laws

   The Site and Services can be accessed from all fifty states, as well as from other countries around the world. By accessing or using the Site and Services, you agree that the laws of the State of Maryland, United States of America, without regard to conflicts of laws principals thereof, will apply to all matters relating to the Site. You agree and hereby submit to the exclusive personal jurisdiction and venue of the State of Maryland and the state and federal courts located therein with respect to such matters.

   You agree that use of the Site and Services shall be deemed a passive service based solely in Maryland and shall not give rise to personal jurisdiction over Magnolia Rifle either specific or general, in any state or jurisdiction other than Maryland.

    You may need your own Magnolia Rifle account to use certain aspects of the Website, and you may be required to be logged in to the account and have a valid payment method associated with it. Magnolia Rifle does sell products for children, but it sells them to adults, who can purchase with a credit card or other permitted payment method. Risk of Loss

  All purchases of physical items from Magnolia Rifle are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

Returns, Refunds & Title

   Magnolia Rifle does not take title to returned items until the item arrives at our headquarters. At our discretion, a refund may be issued without requiring a return. In this situation, Magnolia Rifle does not take title to the refunded item. 

Product Descriptions

    Magnolia Rifle attempts to be as accurate as possible. However, Magnolia Rifle does not warrant that product descriptions or other content of the Website is accurate, complete, reliable, current, or error-free. If a product offered by Magnolia Rifle itself is not as described, your sole remedy is to return it in unused condition. 

Pricing

    "List Price" means the suggested retail price of a product as provided by a manufacturer, supplier, or seller. 

   With respect to items sold by Magnolia Rifle, we cannot confirm the price of an item until you order. Despite our best efforts, a small number of the items in our catalog may be mispriced. If the correct price of an item sold by Magnolia Rifle is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation. Other merchants may follow different policies in the event of a mispriced item. 

We generally do not charge your credit card until after your order has entered the shipping process.

Sanctions & Export Policy

    You may not use any the Website if you are the subject of U.S. sanctions or of sanctions consistent with U.S. law imposed by the governments of the country where you are using the Website. You must comply with all U.S. or other export and re-export restrictions that may apply to goods and services.

Governing Law and Jurisdiction  

    All matters relating to the Website and these Terms of Use and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the State of Maryland without giving effect to any choice or conflict of law provision or rule (whether of the State of Maryland or any other jurisdiction).

Any legal suit, action or proceeding arising out of, or related to, these Terms of Use or the Website shall be instituted exclusively in the federal courts of the United States or the courts of the State of Maryland, in each case located in the United States District Court for the District of Maryland or the state courts within Worcester County, Maryland, although we retain the right to bring any suit, action or proceeding against you for breach of these Terms of Use in your country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

Arbitration  

    At Company’s sole discretion, it may require You to submit any disputes arising from the use of these Terms of Use or the Website, including disputes arising from or concerning their interpretation, violation, invalidity, non-performance, or termination, to final and binding arbitration under the Rules of Arbitration of the American Arbitration Association applying Maryland law.

Waiver and Severability  

    No waiver of by the Company of any term or condition set forth in these Terms of Use shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of the Company to assert a right or provision under these Terms of Use shall not constitute a waiver of such right or provision.
